71.1

Policy

 

Normal operations of the University in Lexington to include the Lexington Campus and the Medical Center (except the University Hospital) sectors and the Lexington Community College (L.C.C.) may be curtailed by declaration of the President of the University or the administrator acting for the President. Normal operations at a community college, except L.C.C., may be curtailed by declaration of the president of the community college. This curtailment may be done for unusual conditions such as severe weather, fuel shortages, or other calamities.

 

71.1.1

Regular full-time and half-time staff employees will continue to be paid for normally scheduled hours during the emergency University conditions. Those employees on vacation, temporary disability or special leave(s) will not be entitled to the provisions of this policy.

 

71.1.2

Vice chancellors, deans, and directors shall designate functions within their area of responsibility which will operate even though other functions may be curtailed.

 

71.1.3

Each vice chancellor, dean, or director shall promulgate emergency plans to maintain the operation of functions which shall not be curtailed during the emergency.

 

 

71.1.3.1

For a period of emergency, regular full-time and half-time employees affected by these plans and required to work during a period of emergency shall receive time off with pay on another scheduled work day, within a specific period of six (6) weeks, unless a longer period is approved by the appropriate vice president or chancellor, at the convenience of the department. Pay, in lieu of compensatory time off, is not permissible.

 

 

71.1.3.2

Staff employees who are required to work during a period of emergency but do not report for work as scheduled, without good cause, shall be subject to appropriate disciplinary action, to include dismissal.

 

 

71.1.3.3

Temporary staff employees will not receive time off with pay during a University emergency. However any of these employees who work during emergency shall be paid the normal wage rate for each hour worked.

 

71.1.4

Operations of the University Hospital are essential and remain functional at all times. All employees of the University Hospital are essential and shall report to work as scheduled.

 

 

71.1.4.1

Any emergency condition of the University shall have no effect on the University Hospital.

 

 

71.1.4.2

Staff employees of the hospital who do not report to work as scheduled shall be subject to appropriate disciplinary action, to include dismissal.

71.2

Delegation

 

The authority to designate departments, divisions, or operations which must remain open is delegated to the vice chancellors or other appropriate administrators. Responsibility for scheduling and announcing emergency operations staffing is delegated to department heads for advance preparation an appropriate implementation.

71.3

Procedures

 

71.3.1

Announcement of a University emergency necessitated during period when staff employees may be away from work will normally made through the local broadcast media.

 

71.3.2

When pending curtailments occur, department heads are to be available for consultation with those to whom they report are accountable. Department heads are encouraged to suggest appropriate consideration of an emergency.

 

71.3.3

If the operation is designated as one to remain open during an emergency, department heads will prepare and post or otherwise promulgate to employees the schedule to be implemented.

 

71.3.4

Absences during an emergency are reported as working time unless the working unit is affected by plans described in this policy for operations which remain open during an emergency.

 

71.3.5

For nonexempt staff employees, the time off with pay for working during an emergency, as described in 71.1.3.1 within this policy, will be designated on the employee time record that is completed for the pay period during which the time off with pay occurs.
