This change affects any employee in a position reclassified to non-exempt (or subject to overtime rules). This includes positions that were exempt from overtime rules and paid less than the new minimum salary of $47,476. However, some employees in exempt positions who earn more than this new minimum salary may also be affected.

For example, all employees in a job title must be classified the same. So, if Gail earns $50,000 per year but her colleagues in the same job title earn less than the new minimum salary, all employees in that job title, including Gail, will become non-exempt and therefore eligible for overtime pay.

Exempt campus employees will continue to be paid monthly, while campus non-exempt employees are paid biweekly. For positions that transition to non-exempt, employees will receive a full monthly paycheck on Nov. 30 and begin receiving biweekly paychecks Dec. 16. According to University policy, employees in non-exempt positions accrue vacation leave at different rates. However, any employee who moves from an exempt to a non-exempt position due to the change in the Fair Labor Standards Act will continue to accrue vacation leave at the same rate. As turnover occurs in those positions, employees new to the University will then earn vacation at the standard non-exempt rate.
